SHB 1412: Opening up Opportunities for Relief from LFO Debt

SHB 1412 provides individuals with new and necessary opportunities to seek relief from LFO debt if they are unable to pay. The bill allows courts to waive or reduce certain currently mandatory LFOs based on evidence of a person’s inability to pay and it creates a statute of limitations on the courts’ jurisdiction to collect LFOs, which would provide finality to criminal sentences and the opportunity for community members to move past their convictions. The bill also reinstates provisions that allow people who are incarcerated to ask the court for relief, allowing them to focus on successfully reintegrating into the community.

  • Please take a few minutes to email or call Chair Ormsby and Democratic members of the committee to urge the Appropriations Committee to schedule a public hearing on 1412 and vote before Feb. 22nd!  
  • Sample message: “Dear Representative, please urge a hearing in the Appropriations Committee on Substitute House Bill 1412, concerning relief from legal financial obligations. This bill expands judicial discretion by allowing courts to waive certain LFOs and interest for people who are poor and lack the ability to pay and can show evidence of indigence. This bill is fiscally responsible because, rather than mandating waiver or reduction of LFOs, the bill simply opens the door for individuals to seek waiver before a judge if they lack the ability to pay. Only people who cannot pay will see these LFOs go away, causing minimal impact to budgets. Thank you for supporting this incredibly important piece of legislation. Sincerely, (YOUR NAME).”

SHB 1282: Restoring Earned Release Time for Incarcerated Individuals

SHB 1282 would restore Washington’s earned time accrual rate to 33% percent; allow incarcerated individuals to earn time off their sentence through participation in education, employment, and rehabilitative programming; and apply retroactively. Together, these changes will help undue the decades of “tough on crime” policies that resulted in systemic racial disproportionality in Washington’s criminal justice system. At the same time, SHB 1282 will save the State $19.4 million in 2022 and $26.9 million in 2023.

What you can do to support:

We are currently waiting for the House Appropriations Committee to schedule SHB 1282 for a hearing. Thankfully, this bill does not need to be heard before Feb. 22nd, so we have more time. In the meantime, you can email the members of the appropriations committee (contact info below) and encourage them to support SHB 1282.
