We are proud to release this Habeas Toolkit: a self‑help resource designed for individuals detained at the Northwest ICE Processing Center (NWIPC) and for the wider immigrant community. Although this guide can be useful to anyone seeking to understand the habeas process, it was created with detained individuals in mind.
At the core of this project is a simple belief: knowledge is power. Understanding available legal options can bring clarity during an incredibly difficult and isolating time.
This toolkit grew out of our review of the systemic barriers faced by pro se individuals who file habeas petitions on their own. One example is the $5 filing fee or the lack of access to the correct in forma pauperis form, which can derail a petition before it is ever considered by the court. Failure to satisfy this administrative requirement has led to delays, improperly filed cases, or dismissals. These patterns, and the harm they cause, shaped every part of this toolkit.
We are especially grateful to the individuals in detention who navigated federal court litigation without legal representation and who shared their experiences with us. Their insight, resilience and perseverance were essential to understanding the barriers that exist in practice, not just on paper. We also thank Global Rights Advocacy for their partnership and their continued commitment to supporting people inside NWIPC.
No single guide can fully untangle a system that is, in many ways, intentionally complex. Still, having access to clear, concrete information is far better than facing the process alone. Creating this toolkit has been a meaningful undertaking, and we sincerely hope it serves as a practical and empowering resource for those who need it most.
